By accessing or using SafariCad's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

These terms apply to all users of the service, including tourists, vendors, and any other visitors to our platform.

2 Description of Services

SafariCad provides a digital payment platform that enables:

• Tourists to make cashless payments to registered vendors in Kenya
• Currency conversion from USD, EUR, and GBP to Kenyan Shillings (KES)
• QR code-based payment processing
• Digital wallet management and transaction history
• Vendor registration and payout services via M-PESA

3 Eligibility

To use SafariCad services, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Complete identity verification (KYC) as required
• Not be prohibited from using financial services under applicable laws

4 User Accounts

You are responsible for maintaining the confidentiality of your account credentials, including your password and PIN. You agree to:

• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account
• Provide accurate and up-to-date information

5 Payments & Fees

By using our payment services, you acknowledge and agree that:

• All payments are processed in Kenyan Shillings (KES)
• Currency conversion rates include a margin over the mid-market rate
• Transaction fees may apply as disclosed at the time of transaction
• Completed transactions cannot be reversed except in cases of fraud or error
• Vendor payouts are subject to M-PESA processing times and fees

6 User Conduct

You agree not to use SafariCad for:

• Any illegal or unauthorized purpose
• Money laundering or terrorist financing
• Fraudulent transactions or identity theft
• Circumventing security measures or transaction limits
• Any activity that violates Kenyan financial regulations

7 Vendor Terms

Vendors using SafariCad agree to:

• Provide accurate business information during registration
• Display QR codes and vendor codes prominently
• Honor all transactions processed through the platform
• Maintain valid M-PESA registration for payouts
• Comply with all applicable business and tax regulations

8 Limitation of Liability

SafariCad shall not be liable for:

• Service interruptions due to technical issues or maintenance
• Losses resulting from unauthorized account access due to user negligence
• Disputes between users and vendors regarding goods or services
• Currency fluctuations between the time of top-up and payment
• Delays in M-PESA payouts due to network issues

9 Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent or suspicious activity
• Fail to complete required identity verification
• Provide false or misleading information

Upon termination, any remaining balance will be refunded to your original payment method, subject to applicable fees and verification requirements.

10 Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or in-app notification. Continued use of the service after changes constitutes acceptance of the new terms.
